Alimony, Spousal Support or Maintenance

Depending on the jurisdiction, periodic and regular court-ordered payments by one spouse to another subsequent to divorce is called alimony, spousal support or maintenance. Although alimony guidelines vary from state to state, there are five main types:

  • Permanent alimony is support that continues indefinitely, ceasing only at the death of either party, or the remarriage of the spouse receiving the support. (An arrangement to live with another person as if married can be challenged legally for purpose of  discontinuing support.)
  • Temporary alimony occurs during separation prior to finalization of the divorce. Although it can go to permanent subsequent to divorce, it does not do so necessarily.
  • Lump-sum alimony means a single payment to the recipient, usually by agreement rather than a court-ordered award. It is not based on financial need but on Equitable Distribution principles. For example, it is used when one spouse was finishing college or graduate school while the other paid all bills and should be reimbursed.
  • Reimbursement alimony is the result of a spouse who put the other through school, bearing the expenses. Should a divorce happen almost immediately after the schooling is completed, a court will order reimbursement of expenses to the spouse who supported the other throughout the paid-for schooling period.
  • Rehabilitative alimony is required to support a spouse who stays at home with the children so that day-to-day expenses can be paid while the recipient gets training for purposes of supporting children without spousal support. For example, a mother who is caring for two small children may get rehabilitative alimony to help her join the workforce eventually.

Obtaining an Alimony Adjustment in Divorce Court

As financial circumstances change, the amount that one spouse must pay out in maintenance to the other is, of course, subject to change. A well-drafted divorce agreement will require a review of financials every couple of years. If the financial situation of the recipient improves as a result of a raise or career promotion, a court may order a decrease in the payout amount. For example, when a custodial spouse completes schooling to become self-supporting, alimony payments can be discontinued or adjusted accordingly. Conversely, if a payor’s financial situation deteriorates unexpectedly, the amount due may also be modified in accordance with reduced circumstances.
